1. Acceptance of Terms
By accessing or using Biopinix Game Builder™ (the "Service"), operated by Biopinix, LLC ("we," "us," or "our"), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Biopinix Game Builder is a no-code platform for creating and playing browser-based games. Features may change over time. Any future offering will have separately disclosed seller and purchase terms.
3. User Accounts
You are responsible for accurate account information, protecting your credentials and activity under your account. Notify us promptly of unauthorized access. The Service is not directed to children under 13. If you are a minor, use the Service only with the permission of a parent or guardian and as permitted by applicable law.
4. Content Ownership and Rights
You retain your rights in the games, maps, writing, artwork and other content you upload or create ("User Content"). We claim no ownership of your AI-generated project outputs. Any rights in AI outputs depend on applicable law and third-party terms; we do not guarantee that outputs qualify for copyright protection or are exclusive.
You grant us a limited, non-exclusive license to store, process, transmit and display User Content to provide the Service, including displaying content you choose to share. This license ends when the content is deleted, except for legal or backup retention. Sharing an asset collection does not automatically transfer ownership; creators must provide any intended reuse license.
You represent that you have the necessary rights to your submissions and that they do not violate another person's intellectual property, privacy or publicity rights. Built-in assets, third-party assets and software remain subject to their applicable licenses.
5. Acceptable Use
Do not use the Service to:
- Upload or distribute unlawful, abusive, infringing or harmful material.
- Impersonate others or misrepresent your affiliation.
- Circumvent game access controls or attempt to access another user's private games or files.
- Disrupt the Service, distribute malware or use it for spam.
- Submit confidential information or another person's personal information without appropriate permission.
6. AI-Generated Content
AI features process your prompts and any reference files you choose to provide. Outputs and planning suggestions can be inaccurate, inappropriate or similar to other content. Review generated assets, rules and missions before use or sharing. You are responsible for confirming that your use is lawful and permitted by applicable licenses. Generation estimates are estimates, not guarantees of a particular output or cost.
7. Paid Features and Credits
Some features may require Pro access or generation credits. Any paid offering will disclose its price, allowance, renewal and cancellation terms before purchase. No game-selling or Stripe Connect payment service is offered through this version of the Service. Nothing in these Terms promises an active checkout, automatic renewal, a particular refund rule or a seller revenue percentage. Where a paid offering is available, its disclosed purchase terms and applicable law govern.
8. Data Storage and Availability
We use cloud infrastructure to store games and assets. Keep backups of important content. Private game definitions require authorized access, but an asset served through our public asset delivery domain can be viewed or shared by anyone who has its URL. Do not upload sensitive or confidential media expecting its delivery URL to enforce purchase access. We do not guarantee uninterrupted availability or permanent preservation.
9. Termination
We may suspend or terminate access for violations of these Terms, legal requirements or conduct that harms the Service or others. You may request account closure by contacting us. Legal obligations and necessary backup retention may continue after closure.
10. Disclaimer of Warranties
TO THE EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR UNINTERRUPTED OPERATION.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIOPINIX, LLC IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. These Terms do not exclude rights or liabilities that cannot lawfully be excluded.
12. Changes to Terms
We may revise these Terms. The current version and effective date will be posted here. We will provide notice of material changes as required by law. Continued use after changes take effect is subject to the revised Terms.
13. Governing Law
These Terms are governed by the laws of Arizona, United States, without regard to conflict-of-law rules, subject to mandatory protections that apply in your jurisdiction.
14. Dispute Resolution and Binding Arbitration
This section affects your legal rights. Before starting arbitration, you and Biopinix, LLC agree to attempt informal resolution for at least 30 days. Send written notice describing the dispute and requested relief to [email protected].
To the extent permitted by law, unresolved disputes relating to these Terms or the Service will be resolved through individual binding arbitration administered by JAMS or the American Arbitration Association under applicable rules, before one arbitrator in Maricopa County, Arizona, or remotely. Either party may bring an eligible individual small-claims case or seek court relief to protect intellectual property or prevent unauthorized access. Mandatory consumer protections continue to apply.
You may opt out of arbitration by emailing [email protected] within 30 days of first accepting these Terms, with your name, account email and a clear opt-out statement.
15. Class Action Waiver
To the extent permitted by law, disputes must be brought individually, not as a class or representative action. An arbitrator may not consolidate unrelated parties' claims. If this waiver is unenforceable for a particular claim, that claim may proceed in court and other claims remain subject to arbitration. Any jury-trial waiver applies only where legally enforceable.
